Welcome to ROOTED! The terms "we", "us" and "our" refer to ROOTED, based in Pretoria, South Africa. ROOTED operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). ROOTED is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (these "Terms"), describe your rights and responsibilities when using the Services. These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

However, please note that colours and product appearance may vary from what is displayed on your screen due to your device type, settings, and configuration. We cannot guarantee that your screen's display of any colour or image will be accurate.

While we strive to ensure all product descriptions are accurate and up to date, descriptions are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities available to any person, geographic region, or jurisdiction at our sole discretion.

Product availability is not guaranteed. In the event that a product becomes unavailable after your order is placed, we will notify you promptly and offer a suitable alternative, a store credit, or a full refund.

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time.

Please note that in accordance with the Consumer Protection Act 68 of 2008, your statutory rights as a South African consumer are not affected by these Terms, including your right to receive goods of good quality, in good working order, and free of defects.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. ROOTED reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until ROOTED confirms acceptance via email. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as ROOTED may be unable to accommodate cancellation requests once an order has been accepted. In the event that we do not accept, modify, or cancel your order, we will notify you using the contact details provided at the time of purchase.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

All prices are displayed in South African Rand (ZAR). Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, as confirmed in your order confirmation email.

From time to time, we may offer promotions governed by separate terms and conditions. Where there is a conflict between promotion terms and these Terms, the promotion terms will apply.

You agree to provide accurate, current, and complete payment and account information for all purchases. You warrant that you are authorised to use the payment method provided and that all charges will be honoured. You agree to promptly update your account information, including email address and payment details, to ensure successful transactions.

SECTION 5 - SHIPPING AND DELIVERY

ROOTED ships within South Africa only, using Aramex as our courier partner. Estimated delivery times are 5–10 business days from the date of dispatch. Where stock is available, same-day delivery may be offered. All delivery timeframes are estimates only and are not guaranteed.

We offer free shipping on all orders within South Africa.

We are not liable for delays caused by the courier, unforeseen circumstances, or events outside our control. Once your order has been handed to the courier, risk of loss or damage passes to you. If your order is lost or damaged in transit, please contact us at rootedstore.support@gmail.com and we will assist you in resolving the matter.

SECTION 6 - INTELLECTUAL PROPERTY

All content on our Services, including trademarks, text, images, graphics, video, audio, product reviews, and the design and arrangement thereof, is owned by ROOTED or its licensors and is protected under South African and international intellectual property laws, including the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993.

ROOTED's name, logo, and brand elements are trademarks of ROOTED and may not be used without prior written permission. Shopify's name and logo are trademarks of Shopify Inc. All other trademarks belong to their respective owners.

We may provide access to optional third-party tools as part of the Services. These tools are provided "as is" and "as available" without any warranties or endorsement from ROOTED. We have no control over these tools and accept no liability for their use. ROOTED is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made in our store are made directly with ROOTED. By using the Services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and ROOTED, including any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with ROOTED.

All personal information collected through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you confirm that you have read and understood both privacy policies.

You warrant that you own or have all necessary rights to your Feedback, that you have disclosed any compensation received in connection with it, and that it complies with these Terms. We are under no obligation to maintain Feedback in confidence, pay compensation for it, or respond to it.

We may, but are not obligated to, monitor, edit, or remove Feedback that we determine to be unlawful, offensive, defamatory, or otherwise objectionable. You are solely responsible for the accuracy and content of any Feedback you submit.

Occasionally, information on our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors or inaccuracies and to cancel orders where information is found to be incorrect, at any time and without prior notice.

We reserve the right to suspend or terminate your account at any time if you violate these Terms.

14.1 This section applies if you use, enable, or deploy an automated agent ("Agent") — meaning any software or service that takes autonomous or semi-autonomous action on your behalf — to access or interact with the Services.

14.2 No Agent may access the Services unless it identifies itself and complies with the requirements in section 14.4 at all times. No Agent may access the Services if we have requested it to refrain from doing so.

14.3 We may limit, including by technical means, whether and how any Agent accesses the Services.

14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not conceal or mimic human behaviour or circumvent CAPTCHAs; (iii) respond truthfully when asked whether interactions are from a human or computer; and (iv) not circumvent any measures intended to block or limit Agent access.

We may terminate this agreement or your access to the Services at any time, at our sole discretion and without notice. You remain liable for all amounts due up to the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

Please note that in accordance with the Consumer Protection Act 68 of 2008, your statutory rights as a South African consumer are not excluded or limited by this disclaimer.

SECTION 17 - LIMITATION OF LIABILITY

To the fullest extent permitted by South African law, ROOTED, our partners, directors, officers, employees, affiliates, agents, contractors, and service providers (including those of Shopify and its affiliates) shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, loss of data, or replacement costs, arising from your use of the Services or any products purchased through the Services.

Nothing in this section limits ROOTED's liability for death, personal injury, or any liability that cannot be excluded under the Consumer Protection Act 68 of 2008 or other applicable South African law.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ROOTED, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim. We may control the defence and settlement of such claim at your expense but will not settle any claim requiring non-monetary obligations from you without your consent.

SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed from these Terms without affecting the validity of the remaining provisions.
